Is there a reason we can't just loop for a set number of iterations, exit earlier than that number, and check we don't hit that number? That feels more deterministic and preferable to me, but if that's difficult for some reason or complicates the test in some way I'm not seeing, then maybe a timeout is a reasonable backup
