I don't think it's that complicated.  Tom, we allow people to use the LLVM testsuite for general testing purposes both commercial and not.  Is it ok with you for it to be redistributed as part of the testsuite, following the general goal of allowing open access an unrestricted use?

If so, we just need a statement from you that indicates this, and to update the included LICENSE.txt file to reflect that.  If not, we need to comply with your license, and we'll be forced to remove the code.  Very few people will be able to benefit from your work, but complying with your requirements is our foremost priority.
