Wait, i40 is legal with a 16-bit byte? That seems wrong to me. Shouldn't
the a "byte" be the minimal (or part of the minimal) access size? I wonder
if you actually want an 8-bit byte but double-byte addressing.

Regardless, restricting this optimization to only byte-multiples seems like
the way to go then.
